The Board of New River Service Authority dba New River Behavioral HealthCare meeting in regular session Thursday, October 25, 2007 declared as surplus certain property owned by New River Service Authority dba New River Behavioral HealthCare and commonly known as Carolina Friendship House and authorized sale by the negotiated offer and upset bid process. Subject property being located at 347 Oak Street, Boone, NC contains approximately .41 acres with house. The property is a two story brick house, 3 bedrooms, 1 ½ bath with additional ½ bath upstairs, dining room, kitchen, large living room, 2 multi-purpose rooms (offices), enclosed front porch, small basement, and paved driveway. Instructions to Bidders

BEGINNING at an iron set which is located North 75 degrees 08 minutes West 716.73 feet from an iron found at oak at fence corner, which is located North 52 degrees 53 minutes West 807.76 feet from NGS "Heights concrete monument found N=658, 964,565, E=, 1,144,324.0986, and running North 75 degrees 08 minutes West 405.74 feet to an iron set; thence South 24 degrees 34 minutes West 157.19 feet to an iron found; thence South 83 degrees 46 minutes East 29.78 feet to a point; thence South 57 degrees 40 minutes East 74.87 feet to an iron set; thence North 24 degrees 34 minutes East 155.00 feet to an iron set; thence South 74 degrees 30 minutes East 300.00 feet to a 10 inch white pine; thence North 27 degrees 26 minutes East 23.95 feet to the point of beginning. Containing 0.53 of an acre, designated as Tract 2, as shown on Map of Survey by Michael M. Lacey, R.L.S., L-1407, dated May 15, 1956 and of record in Map Book 24, Page 56, of the Avery County Registry. Together with improvements located thereon; said property being located at 110 Sugar Mountain Road 2, Newland, North Carolina.
SUBJECT to Road Right of Way as set out in deed of recorded in Book 68, Page 348, of the Avery County Registry.
EXCEPTING an easement and right of way for any existing water pipelines.
Trustee may, in the Trustee's sole discretion, delay the sale for up to one hour as provided in
NCGS §45-21.23.
Should the property be purchased by a third party, that person must pay the tax of Forty-Five Cents ($0.45) per One Hundred Dollars ($100.00) required by NCGS §7A-308(a)(1).
The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance "AS IS, WHERE IS" Neither the Trustee nor the holder of the note secured by the deed of trust/security agreement, or both, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either the Trustee or the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. Also, this property is being sold subject to all taxes, special assessments, and prior liens or encumbrances of record and any recorded releases.
A cash deposit or cashier's check (no personal checks) of five percent (5%) of the purchase price, or seven hundred fifty dollars ($750.00), whichever is greater, will be required at the time of the sale.
An order for possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold.
Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may after receiving the notice of sale, terminate the rental agreement upon 10 days' written notice to the landlord. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
